CAF Appeal Board on 13th March 2015 at the Hotel King Fahd in Dakar, Senegal. The Tunisian Federation was represented at the hearing by its 1st Vice President, Mr. Maher Snoussi.
The Appeal Board noted the the great dignity of the intervention of the Tunisian Football Federation (FTF) during that hearing.
As a reminder, the Organising Committee of the Africa Cup of Nations and the Executive Committee of CAF meeting in Malabo on 6 February 2015 had ordered the Tunisian Federation to comply with the decisions of the Disciplinary Board, including rendering an apology to CAF or presenting a letter with irrefutable, tangible evidence to substantiate the claims of CAF being biased against the Tunisian team by 31st March 2015 or the Executive Committee would decide to exclude the team of Tunisia from qualifying for the AFCON2017.
The Appeal Board held that it was unnecessary to examine the pleas and complaints raised by the FTF in its appeal brief, the principle of the materiality of the facts being prosecuted recognized. The board therefore decided to:
Ø Declare the appeal lodged by the FTF receivable in law,
Ø To reject it in substance,
Ø Confirm the decision of CAF Disciplinary board dated 3rd February 2015,
Ø The fees and expenses relating to the procedure before the Appeal’s board by the appellant pursuant to Article 58 CAF Disciplinary Code,
Ø The amount of 3000 US Dollars representing the deposit paid by the FTF reference to Article 58 of the abovementioned CAF Disciplinary Code is retained by CAF.
