Sunday World reports that, a judgement has been passed against Mamelodi Sundowns midfielder Teko Modise to pay R 80 000 in commission to the property estate agent Homenet for a house he should have bought but instead failed to back in 2009.
According to the court documents seen by Sunday World, it said that Teko had signed an offer of R 1050 000 to purchase a house in Eastleigh suburb in Edenvale, east of Johannesburg, in July 2008.

“In terms of clause 18, the offer was irrevocable until midnight on, July 11, 2008. The sellers, Xianwen Zeng and Ping Lin, duly accepted the offer on July 10, 2008 at Eastleigh,” read the judgement. “The offer was not suspensive upon the defendent obtaining finance for the purchase of the property. On October 3, the conveyancers attending to the transfer of the property were advised by the bond originating attorneys that the defendent did not have sufficient funds to cover the shortfall and that the said sale could not proceed.”
“In terms of clause 7 of the offer to purchase, the defendent is liable to pay the plaintiff, as estate agent, an amount of R 80 000.”
Hometown’s lawyers said Teko had no interest in paying the commission.
“To date, despite demand attached, the defendent has failed and or, alternatively, neglected and or, alternatively, refused to make payment to the plaintiff for the amount as aforesaid” read the summons.
The magistrates court granted the judgement saying they should seek further and or alternative means to recover their money from Teko.
“In terms of clause 7 of the offer to purchase, the defendent is liable to pay the plaintiff, as estate agent, an amount of R 80 000.”
Hometown’s lawyers said Teko had no interest in paying the commission.
“To date, despite demand attached, the defendent has failed and or, alternatively, neglected and or, alternatively, refused to make payment to the plaintiff for the amount as aforesaid” read the summons.
The magistrates court granted the judgement saying they should seek further and or alternative means to recover their money from Teko.
